Acceptable Use Policy

The Internet is intended for use by mature adults (and by minors when supervised by mature adults). Our customers are expected to use the Internet with respect, courtesy, and responsibility, giving due regard to the rights of other Internet users.

The customer is expected to have a basic knowledge of how the Internet functions, the types of use which are generally acceptable, and the types of use which are to be avoided.

Common sense is the best guide as to what is considered acceptable use. The following are unacceptable uses:

Illegality in any form, including but not limited to activities such as unauthorized distribution or copying of copyrighted software, violation of U.S. export restrictions, harassment, fraud, trafficking in obscene material, drug dealing, and other illegal activities.

Net abuse, including but not limited to activities such as using a non-existent email return address on a commercial solicitation, spamming (sending unsolicited advertising to numerous email addresses or newsgroups and/or generating a significantly higher volume of outgoing email than a normal user), trolling (posting outrageous messages to generate numerous responses), mail bombing (sending multiple messages without significant new content to the same user), subscribing someone else to a mailing list without that person's permission, cross-posting articles to an excessive number of newsgroups, or attempting without authorization to enter into a secured computer system. Merritt-Gentry reserves the right to determine what constitutes net abuse.

Tortuous conduct, including but not limited to posting of defamatory, scandalous, or private information about a person without their consent, intentionally inflicting emotional distress, or violating trademarks, copyrights, or other intellectual property rights.

Misuse of system resources, including but not limited to employing posts or programs which consume excessive CPU time or storage space; permitting use of mail services, mail forwarding capabilities, POP accounts, or auto responders other than for the customer's own account; or resale of access to CGI scripts installed on our servers.

Adult related material including, but not limited to pornographic pictures, banners, text, or any other content that Merritt-Gentry considers offensive. Any content considered as pornographic will be removed off of the server without prior notice.

Service Contract:

Merritt-Gentry reserves the right to change fees, surcharges, or institute new fees at any time upon thirty (30) days prior notice via email or snail mail.
In the event of non-payment, any breach of this agreement, or for any other reason within the sole discretion of Merritt-Gentry, Merritt-Gentry shall have the right to immediately, without need for notice, terminate client's virtual hosting account.
Client specifically agrees not to upload, post, or reproduce in any way materials protected by copyright without the permission of the copyright holder.
This agreement is not assignable or transferable without express written consent of Merritt-Gentry
Merritt-Gentry's hosting services may only be used for lawful purposes. Transmission of any material in violation of any U.S. or any State's regulation is prohibited. This includes but is not limited to: copyrighted material, material legally judged to be threatening of obscene, material protected by trade secret, or in any way a violation of intellectual property laws.
Client specifically agrees to indemnify and hold Merritt-Gentry harmless in any legal action which arises as a result of your use of our service, without limitation or exception. This indemnification extends to all issues associated with your account, including but not limited to domain name selection and web site content.
Merritt-Gentry reserves the right to refuse or discontinue service to anyone at any time, at their sole discretion.
You agree that we have the right and responsibility to fully cooperate in any legal investigation regarding any aspect of our services, including services sold to you. Please note that any use of our system to engage in software piracy or similar violations will result in account suspension and an immediate report to the FTP, SPA, and appropriate local authorities.
The agreement constitutes the entire agreement between the parties hereto. The terms and conditions of this agreement shall be interpreted and enforced pursuant to the laws of the State of Nebraska.
